Amendments to the Regulations on Plastics Used in Food Contact

The EU’s regulations on food contact materials are mainly aimed at ensuring that plastic materials for food packaging and containers are not harmful to human health and to ensure food safety. These regulations address aspects such as the composition of plastic materials, production processes, use restrictions and labeling.

The 16th amendment revokes the authorization of wood flour and fibers, untreated and salicylic acid, and adds the following substances to the positive list of Annex I:

• tris(2-ethylhexyl)benzene-1,2,4-tricarboxylate
• (triethanolamine-perchlorate, sodium salt) dimer
• N, N-bis(2-hydroxyethyl)stearylamine partially esterified with saturated C16/C18 fatty acids
• phosphoric acid, mixed esters with 2-hydroxyethyl methacrylate
• benzophenone-3,3’,4,4’-tetracarboxylic dianhydride (BTDA)

Other changes to the Plastics Regulation include amending the specific migration levels (SMLs) and/or restrictions and specifications for four phthalates, namely:

• phthalic acid, dibutyl ester (DBP)
• phthalic acid, benzyl butyl ester (BBP)
• phthalic acid, bis(2-ethylhexyl) ester (DEHP)
• phthalic acid, diesels with primary, saturated C8-C10 branched alcohols, more than 60% C9 (DINP)

Impact of regulations on plastics used in food contact

Intermediate materials and products used in the manufacture of plastics materials and articles, which comply with Regulation (EU) 10/2011 applicable before the entry into force of this Regulation and which are placed on the market for the first time after 1 May 2024, but which do not comply with this Regulation, such intermediate substances or The declaration of conformity of the product shall indicate that it does not comply with this Regulation and that it may only be used for the manufacture of plastic materials and articles which will be placed on the market before 1 February 2025.
